FACE OF AUSTRALIAN SKIN CLINICS 2015 COMPETITION TERMS AND CONDITIONS

Promoter: The Promoter is ASC Master Franchise Pty Limited ACN 153 138 268 trading as Australian Skin Clinics (“ASC”), Levels, 87-89 Upton Street, Bundall, Queensland 4217. Telephone (07) 5509 0000 (“ASC National Head Office”).

Promotion:

1. The “Face of Australian Skin Clinics 2015 Competition” promotion (“Promotion”) will commence at 5.00pm on Friday 28 November, 2014 and conclude at 12.00 midnight on Friday August 14, 2015 (“Promotion Period”). All times are listed in Australian Eastern Standard Time.
2. The selection draw (“Winner and Runners Up Selection Draw”) will take place at the ASC National Head Office (“Draw Location”) at 10.00am on Tuesday 10 March, 2015

Entry requirements

3. Participation in the Promotion is open to all persons who are:

• 18 years of age or older; and
  • 30 – 45 years old; and
  • 46 – 65 years old
  • An Australian resident.

People who meet the above conditions and continue to satisfy the conditions during the Promotion Period are referred to as “Eligible Member/s” and will be entitled to enter the Promotion.

4. The Promoter reserves the right to refuse any person participation in the Promotion at any time.
5. If the Eligible Members selected, satisfies the terms and conditions and the selection process, they may be deemed the winner (“Winner/s”) or the runner up (“Runner/s Up”) of the prize as detailed in Condition 8, and that Winner/s and Runner/s Up will be notified via email of their win.

Entry into the Winner/s and Runner/s Up Selection Draw

6. To be eligible to win the prize in the Winner/s and Runner/s Up Selection Draw, an Eligible Member must:

• Register their interest to receive an application pack;
• Complete and meet all required fields for the Promotion application pack;
• Provide 2 images as requested and detailed within the Promotion application pack; The photographs must not have been enhanced or altered by any means.
  • An Entrant who is registered with a modelling agency is not eligible to enter the Competition unless they are legally and contractually able to represent ASC Master Franchise from 27th February 2015.

Winner/s and Runner/s up Selection Draws
7. On Tuesday, 10th March, 2015 six Eligible Members will be selected by a representative of the Promoter. The Eligible Members will be broken down into the following categories;
I. Male Winner (1 Eligible Member);
II. Female Winner (1 Eligible Member);
III. 1 Male Runner/s Up (1 Eligible Member); and (per age category)
IV. 1 Female Runner/s Up (1 Eligible Member) (per age category)

Winner/s and Runner/s Up Selection Draw Prize
8.  a) The Winner/s will, subject to compliance with these Conditions of Entry, each win:

• Recognition within the ASC brand for being the Face of Australian Skin Clinics for 2015; and
• participation in the Face of Australian Skin Clinics photo shoot; and
• receive up to $15,000 in ASC retail treatment value as determined by a nominated ASC technician and is dependent upon a suitable treatment schedule that is recommended by our qualified and nominated technician. ASC reserves the right to provide a lesser amount in treatment value if treatment schedule dictates. All treatment schedules are subject to the Winners medical history, skin type, age and physical features; and
• a $2,000 cash prize; and
• a $3,000 ASC gift card for use at any ASC Clinic on laser and skin services only (“Gift Card”). The gift card will expire on 10 March, 2016 and cannot be used on injectable services (the “Prize”).

1. b) The Runner/s Up will, subject to compliance with these Conditions of Entry, each win:
   • Participation in the Face of Australian Skin Clinics photo shoot; and
   • a $3,000 ASC gift card for use at any ASC Clinic on laser and skin services only (“Gift Card”). The gift card will expire on 10 March, 2016 and cannot be used on injectable services (the “Prize”).

9. The Prize is not transferable, exchangeable and not redeemable for cash or any other alternate prize.
10. The Prize cannot be used in conjunction with any other offer or discount. No credit will be given for any unused portion of the Prize.
11. If by 17 March, 2015, the Promoter is unable to contact the Winner/s or Runner/s Up, the Promoter will select an alternate Winner/s or Runner/s Up to claim the Prize. If the Promoter is unable to contact the alternate Winner/s or Runner/s Up for a period of 3 months from the Draw Date, the Promoter may continue to select an alternate Winner/s or Runner/s Up until such time as the Winner/s or Runner/s Up is contacted and the Prize claimed.
12. Once the Runner/s Up or the alternate Runner/s Up has been notified (as the case may be), the $3,000 “ASC” gift card prize will be posted by registered post within 7 business days.

13. The total retail prize pool for this Promotion is $55,873.70 (“Prize Pool”).

General
14. Directors, management and employees of the ASC (including any related body corporate as defined in the Corporations Act 2001) and their immediate families, which has the meaning given to that phrase in the Charitable and Non-Profit Gaming Rule 1999 (Qld) are not eligible to participate in this Promotion. The ASC comprises, but is not limited to the businesses located at Ashmore, Helensvale, Robina, Carindale, Myer Centre, Indooroopilly, North Lakes, Emporium, Chadstone, Knox City, Newmarket, Highpoint, Garden City and Bulimba.

15. Prizes must be taken as stated and cannot be exchanged or redeemed for alternate prizes. Any tax liability or implication which attaches to a prize is the responsibility of the Winner/s or Runner/s Up claiming that prize.
16. The Promoter is not responsible for any loss, damage or injury suffered or claimed (including, but not limited to, indirect or consequential loss or damage, personal injury or death, and direct or indirect loss or damage) by an entrant in relation to entering or participating in this Promotion or taking or using the prizes offered except where that loss, damage or injury was caused by breach of these terms and conditions by the Promoter or the willful or negligent acts or omissions of the Promoter.
17. Conduct of the entire Promotion, including decisions on the eligibility of persons to enter and validity of entry and prizes, shall be the responsibility of the Promoter.
18. To the extent that a situation or issue arises for which these terms and conditions make no provision or in relation to which the relevant terms and conditions are unclear, the Promoter reserves the right to make a decision regarding such situation or issue which is not inconsistent with these terms and conditions.
19. While the Promoter intends to conduct the Promotion as offered, the Promoter reserves the right to cancel or change the Promotion or a prize offered in the Promotion if it can no longer continue the Promotion or offer a prize due to circumstances outside the Promoter’s control.
20. The Promoter accepts no responsibility for late or non-received entries. The Promoter does not guarantee the continuous or fault-free operation of the entry processes, including entry validating and receipting processes, during the Promotion.
21. Any entrant who tampers, or attempts to tamper, with the entry processes or tampers, or attempts to tamper with the processes used for the draws or who submits an entry which is not valid in accordance with these terms will be subject to disqualification at the discretion of the Promoter.
22. The Winner/s and Runner/s Up will be asked to participate in publicity or advertising at the request of the Promoter. 23. Winner/s must be available to attend the nearest clinic for continued treatment during the transformation journey Tuesday, 10th March 2015 to Friday, 14th August 2015 and further available for the Promotion Photo Shoot on Thursday, 30 July 2015 on the Gold Coast, Queensland, Australia. Australian travel expenses will be provided for all 6 Finalists and if required one night’s accommodation will be provided for all 6 finalists during the Promotion Photo Shoot. ASC reserves the right to amend the date of the Promotion photo shoot and will provide all participants 2 weeks’ notice of any change to date and location.
24. All Winner/s and Runner/s Up must sign and ASC treatment consent form prior to any treatments taking place.
25. Photographs and film taken of the Winner/s and Runner/s Up and in any subsequent photo shoots may appear on the ASC website, social media, online and print advertising, in retail outlets and may be used in future ASC advertising. The Winner/s and Runner/s Up must be available to participate in photo shoots/filming/publicity for a minimum of 14 days, during 2015 and agree to attend any publicity or events in conjunction with future ASC competitions or promotions.
